This contract is made between you and Vacanze Lago s.r.l.
The contract is regulated by the law N. 111 of March 17, 1977, by the European Community law 90/314, by international conventions and in particular by the Convention of Brussels of April 23, 1970 which was made active with the law of December 27, 1977 n. 1084, by the Convention of Warsaw of October 12, 1929 in regard to international air transportation made active with the law of May 19, 1932 n. 41, by the Convention of Bern fo February 25, 1961 in regard to train transportation, made active with the law n. 806 of March 2, 1963 concerning touristic packages and in regard to the civil code and other laws in regard to internal Law.
3. Reservation, Confirmation and Payment Conditions
You can make your reservation by telephone or by email. Within 48 hours you will have to pay a 30 % deposit of the total amount of your stay. The balance is required at least 6 weeks before your holiday. In case of booking a luxury villa or a villa with swimming pool we require a 50% deposit of the total amount of your stay to confirm the booking. The booking will be considered confirmed with the payment of the deposit. If there should be any differences between the data on our bank script and the information received through the internet, with this first payment we will automatically confirm the data in regard to our bank script. If you do not pay all payments due in full within 5 days, we reserve the right to cancel your booking. In the case of a short term booking that means made within 30 days before the date of your arrival, the full payment is required, this is the only way the booking will be considered confirmed. Once we receive the total amount, you will receive the documents for your stay that will have to be handed in when you collect the keys of your holiday home. A booking fee of Euro 60,00 will be charged per property. The booking fee is higher for the luxury villas (Euro 100,00).
4. Services and Prices
All bookings are possible for a minimum weekly stay from Saturday to Saturday in high season while the minum stay in low and mid-season is 4 days. Daily and weekly prices are visible in the grid according to the different seasons. Any possible stays which contain 2 different seasons will be calculated by considering the exact number of days of every season. The rental rates do not always include consumption of electricity unless described. Heating costs are extra. It is clearly indicated in the price list whether linen and final cleaning are included and if they are not included these costs will be included in the contract along with the rental rate. If there should be any extra surcharges such as weekly cleaning, weekly change of linen etc.they are to be paid locally. If the accommodation is situated in a village subject to a tourist tax, this shall be payable locally. The information that you find on our website concerning the facilities in the area (such as means of transportation, shops, restaurants etc.) are referred to us by third parties, it is therefore possible that we are not informed of possible changes. It could be is also possible that there could be problems with the correct supply of gas, water and electricity. In these cases and in case of adverse weather conditions, Vacanze Lago s.r.l. is not responsable
5. Changes in Price and Services
We have taken great care to ensure the details of our homes and of our prices. Although there could be some changes that will be communicated at the booking and confirmation stage. If there should be any changes once you have confirmed the booking we will of course advise you immediately. If the changes concern essential points of the contract you are entitled to cancel the booking within 5 days, at no extra charge. You will then receive a refund of the whole amount paid but no further compensation will be paid.
6.Arrival and departure, shortening or extending your stay
Arrivals take place between 4pm and 7pm and you must leave the property by 10 am. If you are not able to arrive within the times indicated here, please contact the person responsible for the keys in order to arrange the arrival. No refunds are possible if you are unable to arrive on the fixed day and time (due to the journey, personal reasons etc.) . Similarly if you have to shorten your holiday no refund can be made for the days unused. If you wish to stay longer please contact our office in time.
7.Cancellation by you
If you cancel a confirmed booking, you may receive:a 50% refund of the total cost if they cancel at least four weeks before check-in and a a 25% refund of the total cost if they cancel at least two weeks before check-in. The administration fee is not refundable. PLEASE NOTE: No refunds will be given for early departure. Depending on the reason for cancellation, you may be entitled to claim from your cancellation policy. We strongly recommend that you take out a private cancellation insurance.
8. Changes or Cancellation by Vacanze Lago s.r.l.
Vacanze Lago reserves the right to change the holiday home with another holiday home of similar price in case of an unexpected accident. For any reason beyond its control or for force majeure (war, natural disaster, fire, sell of the property etc.) Vacanze Lago will immediately cancel the booking and refund all monies paid.
9. Your Liability
Upon arrival you will have to pay to the owner or the key holder a breakage deposit of 200 Euros for the apartments, 400 Euros for the villas and up to 1500 Euros for the luxury villas (the safety deposit may vary according to the villa) which can be paid in cash or sometimes even by credit card The owner or the key holder may refuse to hand over the key if the deposit is not paid. Only the number of people indicated in the booking contract are allowed to enter the reserved property. The key holder has the right not to allow extra people in the house or to ask a surcharge During your stay all local rules should be respected. Tents are not permitted in the case you rent a villa, as they could ruin the garden. When you leave the house you must leave all kitchen appliances clean because this is not included in the final cleaning. Upon departure the whole breakage deposit will be refunded under the condition that the apartment has not been damaged.
10.Complaints and enquiries for refunds
If upon arrival or during your stay you should find differences with what you have booked you should solve the problem with the local key holder. If this person is unable to help you immediately you must call our booking office. In any case the people who have the job of welcoming you do not have the responsibility of dealing with refunds. All complaints and refund enquiries must be sent to our office within 4 weeks following the date of your departure, after this time Vacanze Lago will not answer to any complaints and you won't have the right to ask for a refund.
11. Our Liability
If the characteristics of the home present substantial differences with what is written on the contract and for this reason are not able to give you an adequate stay, Vacanze Lago s.r.l. will offer you an alternative of the same value. If there is no availability or if you refuse the alternative property for valid reasons, Vacanze Lago s.r.l. will refund the whole rental price. Vacanze Lago s.r.l. is not responsable in the following cases:
a)Negligence or appliances that do not work because of third parties.
b) In case of force majeure or of an event which Vacanze Lago s.r.l. and neither the key holder) can foresee
c)Theft in homes
Any discussion about these booking conditions is under the jurisdiction of the court of Lecco . These conditions and the corresponding price list is valid from 01.10.2016 to 01.10.2017 and replaces the previous publications.
This publication is mandatory as in the law L.269/98 art. 16 - the law punishes offences such as prostitution and pornography of minors, even if in a foreign country.
